This seminar, hosted by ASLRRA and taught by Federal Railroad Administration (FRA) personnel, will focus on the Designated Employer Representative’s (DER’s) role with respect to FRA drug and alcohol testing. This program will provide company DERs with a review of the Federal regulations pertaining to the duties they are required to perform in order to comply with FRA’s regulations for drug and alcohol testing. Attendees of this two-day seminar will come away with a clear understanding of their responsibilities under the law. Specifically, DER participants in this training session will:More effectively understand the role of the DER in the drug and alcohol testing process as required by 49CFR Parts 40, 219, 240, and 242.

  • Discuss issues that may arise during the drug testing process and what action is required of the DER
  • Learn more about the DER’s relationship with other partners in the testing process, including Consortium/Third Party Administrators (C/TPAs) and collectors,  Medical Review Officers (MROs), Employee Assistance Programs (EAPs), laboratory personnel, and Substance Abuse Professionals (SAPs)
  • Develop oversight of C/TPA’s and collectors with mock collections
  • Ensure complete compliance with federal rules and regulations to better serve the employees with whom they work using their thorough knowledge of the entire mandated drug and alcohol testing process
  • Better define the DER role in assuring FRA and company policy compliance differences
  • Provide services meeting standards of professionalism, accountability, and ethical behavior, and implement practical application of industry standards and procedures
  • Understand FRA Subpart C, Post-Accident Toxicological Testing requirements
  • Understand the effect of Federal drug and alcohol testing as it relates to locomotive engineer and conductor certifications
  • Additionally, a component of this training session will address Signs and Symptoms of Drug and Alcohol Misuse. Attendance of the Signs and Symptoms and the Part 219 Subpart C portions of the seminar will allow the attendee to comply with the requirements of 49CFR Part 219.11(g).
